The meeting of November 13th, 2008 was called
to order by Chairperson Mary Woznak. All stood and pledged allegiance to
the flag and observed a moment of silence for our Troops overseas.
ROLL CALL: JOSEPH PERUSO-Present, ROBERT

MARY WOZNAK-Present. ALSO Present: RUSS HEIPLE AND SHANNAN KESTER
GOOD AND WELFARE:
Tom Buchan: The Fire Department
has recently updated our alarm cards. Alarm cards are used for how
we dispatch apparatus and equipment. We updated our cards but we can’t
submit any changes without approval from the Board. It can be a blanket
exemption, which allows us to make changes as needed without approval from
the Board ever time we make a change or it can be on an individual basis,
in which case every change we make we would have to present it for approval
from the Board. All the Board has to do is submit a letter stating you
approve the changes as either a blanket exemption or on an individual basis.
Woznak- So you updated the information
and made it more effective? Tom- Yes we did.
Motion made by Woznak to provide a blanket
exemption letter to the 9-1-1 center in regard to the Fire Dep. alarm cards.
2nd by Spanko. 3 ayes. Motion Carried.
Alex Svirsko, Solicitor for the East
Taylor Municipal Authority-The Water Authority is undertaking an expansion
project at the Saltlick Reservoir for a secondary source of water and are
taking out a loan for the project. The Authority was ordained in 1957 for
50 years. Then they did an expansion with a loan from Pennvest for 20 years
and we asked to extend the charter, now for this loan it is another 15-20
years and we would like to extend the charter again.Q: And what
will happen if the charter will expire before the loan?
A: The Township will have to advertise
and the Authority will do all the work involved or Russ can handle it and
the Authority will pick up all the costs associated with the extension
of the charter, whatever you prefer. Heiple- What would you be comfortable
with 50 years? Svirsko- yes you are only allowed 50 years from the
date.

Vojtowicz- So you are asking us
to back the loan? Peruso-No we are asking you to extend the charter.
Vojtowicz- No you are asking us to back the Loan. Heiple-
no this has nothing to do with the loan! THIS is just an extension
of the charter for another 50 years so they can secure the loan. Vojtowicz-
I understand that but if we don’t extend the charter they aren’t going
to get the loan, so In other words we are backing the loan. Svirsko-
you are not responsible for it. Vojtowicz-if you default are we
responsible for it? Svirsko- You are not signing on as a ghost signer.
If you don’t extend the life of the Authority I would assume you would
be responsible because operational law is that the Authority reverts back
to the Township.
Motion made by Vojtowicz to extend the
Charter “Articles of Incorporation” for the Municipal Authority until December
31st, 2057. 2nd by Peruso. All Ayes. Motion Carried.
Motion made by Woznak for an Executive
Session for personal issues. 2nd by Spanko. Executive Session called at
7:18
Regular monthly meeting was reconvened
at 7:37 and called to order by Woznak.
Letter of resignation was presented by
Frank Burns, read by Woznak. Motion to accept Frank Burns’s resignation
letter made by Peruso. 2nd by Spanko. All Eyes. Motion carried.
Motion made by Spanko to nominate
Art Thomson if he accepts, Art- Yes I accept, to fill Frank Burns position
as Township Supervisor. 2nd by Vojtowicz. All Ayes. Motion Carried.
Woznak- Art you will need to get sworn
in by Zanghi’s.

CORRESPONDENCES:
1. Duke Andrews Basketball League requesting
a donation of $300.00 and also requesting a separate donation for the renovation
of the basketball court
Motion to donate$ 300.00 for the Duke
Andrews Basketball League and an additional $100.00 for the renovation
of the basketball court by Peruso. 2nd by Spanko. Roll Call Vote: Peruso-Aye,
Spanko-Aye, Vojtowicz-Aye, Woznak-Aye. 4 Ayes. Motion Carried.
Motion made by Vojtowicz to resign as Police
Commissioner effective immediately. 2nd by Spanko. 3 Ayes .Motion carried.
Motion made by Peruso to appoint Spanko
as Police Commissioner. Vojtowicz stated Spanko cannot be in charge
of his own brother in law. Peruso: besides you are already appointed Road
superintendent . Spanko- What about Art? Vojtowicz- we can’t put
someone in who is not sworn in yet, so it is going to have to be an open
position till the next meeting so they are going to have to report
to all of us. Spanko- here is one point though when anything had to taken
care of in the Police Department, I had to sign paperwork, isn’t
that a conflict of interest. Vojtowicz stated that you were Chairman of
the Board. Spanko- isn’t that conflict of interest? Vojtowicz- It always
been a conflict of interest when you have 2 family members working here,
but we always worked through that. Spanko- the thing is he was here before
I was. Woznak- Wait a minute was it 2 supervisors signing? Vojtowicz- No
it was one. But he can’t immediate supervise a family member, so it is
going to have to be a general council until further notice.
2. Metro Technologies Renewal Contract
Motion to renew our contract with Metro
Technologies for 2009 in the amount of $930.00 made by Peruso. 2nd by Spanko.
Roll Call Vote: Peruso-Aye, Spanko-Aye, Vojtowicz-Aye, Woznak-Aye. 4 Ayes.
Motion Carried.
3. YIS/Cowden Group: Calibration information
for 2009, prepay for the year or monthly?
Motion to pay YIS/COWDEN once a year Peruso.

REPORT OF THE CHAIRPERSON-Woznak
Last month we talked about working with
a collection agency for the back garbage bills and I didn’t get a chance
to talk to the companies so they could come and meet with us so I would
like to bump that until next month. There was a note given to me from Maryann
that there is not going to be enough money in the refuse account to pay
for the garbage service the rest of the year, so once the bills come in
it is going to have to come out of the general. I balanced the refuse account
and the balance in the account right now is $8952.00. and the bills are
a little over $14000.00 a month.
Vojtowicz- so this is going to cost
us a little over 5,000.00? Woznak- No this is going to cost us more, she
only paid September bill, she still has Oct. Nov. and Dec. to pay yet.
And the majority of the quarterly billing has already come in, some will
trickle in but nothing to cover the cost, we may be able to pay October’s
bill, but November, December, I am not even predicting that we will have
enough. Vojtowicz- what do we have left in the Capitol Reserve? Vicki-$4744.00.
Vojtowicz- how are touching the general fund, it is already delegated
to something that is what the Cap. Reserve is for emergency situation and
that is what this is. We can’t go taking money out of the General Fund
to pay a bill that wasn’t expected am I right or wrong?
Vicki- General Fund is for general
that is the word. Do you have any excess? Vojtowicz- I have no idea
I haven’t got a report. Heiple-General Fund money unless it pledged can
be used. Vojtowicz- It is already pledged. Shannan- no we
got excess this year in cable franchise money and earned income. Vojtowicz-
that money should be going in the Capitol Reserve at the end of the year.
Peruso- Let’s face it we are not going to have this problem next year.
Woznak- it is still going to be a $28000.00 problem. Vojtowicz-how do you
figure $28000.00?
Woznak-$14000.00 a month and she
still hasn’t paid Oct. Nov and Dec. Vojtowicz-How much money is
owed out to us yet? Vicki- Didn’t it say somewhere $12000.00? Woznak-
I had a report from last month and it was $12000.00 in past due bills.
Shannan- that was just past due amounts that report didn’t include
any of 2008.
Vojtowicz- So in other words we
may get a lot more money. Vicki- you’re not going to get $28000.00.
Vojtowicz-Do we have enough to cover this month and next month?
Woznak- No you only have $8900.00 in there. Vojtowicz- So
what do we do in this situation Russ?
Heiple-Well you need Nov. and Dec.
money and no money comes on you are going to have to invade the general
fund. Woznak- Then as the collections money starts to come it will
replace what we took out. But I wanted to make you aware. I just got the
note and when I balanced I saw she only had $8900.00 in there and she just
paid September’s bill and we still have Nov and Dec yet.
Vojtowicz- So we are really like
30 days behind on our bill? Woznak- yes and she has nowhere to take
the money. Vojtowicz-how did we get 30 days behind on our bill?
Spanko-it’s what comes in. Vojtowicz- I understand that but
we need to find out why we are 30 days behind on a bill. There is no reason
we should be 30 days behind on a bill. If we are billed in September we
should pay it in September. We shouldn’t be paying September in November.
Spanko- Well if you don’t have the money how are you going to pay
it? Vojtowicz- why isn’t it brought to our attention two months
ago? Spanko- None of you have ever at one time have ever confronted
Maryann about the garbage. Vojtowicz- It is not our job to confront
her, she is an employee of this Board, she is to report to us.
Spanko- one of you meet her in the
office and she will explain this to you. Woznak-I have sat down
with her. Vojtowicz- she has met with her, what I’m saying is why
weren’t we informed up until now? Spanko-Did you ever see how many
outstanding bills? Vojtowicz-Well that’s why we voted the way we
did to go with another deal and let them take the loss instead of the Township.
Heiple- Isn’t it set up that we have 30 days to pay the bills? Vojtowicz-
Do we have any of those bills here? Shannan- She keeps copies. Spanko-What
is the reconciliations that should have been brought up a long time ago,
Mary Woznak should have caught that a long time ago. Vojtowicz-
if we are 30 days behind on our bill then there is a problem there.
Vojtowicz- I am not bad mouthing
Maryann by any means but we should have known about this before it got
to this situation. Spanko- What about the auditors? Vicki-
We told you last year. Spanko- what did you tell us? Vicki-
that you were in the hole. I had it at the audit that you were $800.00
in the hole and if you wouldn’t have started with a 7 thousand some balance
you would have $8,000.00 in the hole. I told you at the meeting and
I can bring up 2 meetings that I told you. Every year you need to start
with a 0 balance and you haven’t been doing that. So in 2007 you started
with a $7000.00 balance and you still ended up $800.00 in the hole.
I told you that at 3 meetings, I can even show you the audit.
Peruso- I remember specifically.
Vojtowicz- So do I. Vicki- So don’t think I didn’t bring
it up. When this company starts in January and I don’t pay my bill and
they don’t come to get my garbage do we have an Ordinance for that? Heiple-
Certainly, the Nuisance Ordinance will cover that. Woznak- Ok here
is the bills; they are billing us a month later. These bills are over $14000.00,
so we are looking $28000.00.Vojotiwcz- so we are looking at $34000.00
because she only has $8000.00 in there. Shannan- a lot of people
wait until the end of the year to pay their bill so you will be getting
more money in. Vojtowicz- worst case scenario is $34000.00 so now
we have to pull the budget out and figure where we are going to get this
money. Shannan- which budget? Vojtowicz- the current 2008
budget. Why don’t we just pull it out of the police budget and lay them
off. No actually I have alot of money left in the police budget. Any
way we look at this it could be devastating. So this $35000.00 could
really devastate us. We have to look ahead to next year and we need the
money in the General account to run the township for the first 4 months,
because we don’t get any money in the first few months until the tax money
starts to come in. We have to look ahead. We have to look at worst case
scenario and make sure we are covered for our future. Do we have enough
in the police budget to cover this?
Motion made by Vojtowicz to freeze the
police budget at $29000.00 General fund, take money out of Capitol Reserve
and Refuse Account until the garbage is paid and then replenish the Capitol
Reserve and General Account once the garbage is paid. 2nd by Peruso.
Roll Call Vote: Peruso-Aye, Spanko-Aye, Vojtowicz-Aye, Woznak-Aye. 4 Ayes.

SOLICITORS REPORT
We advertised for the Sanitary Sewers
and Dye Testing. JETSA is designated as our inspectors which we really
don’t have to do anything because they own the sewage lines. They
can go out and do a program of inspection, but the Ordinance also requires
that upon sale of a property that is connected to a sanitary sewer system
that has to be inspected by JETSA. But I excepted out intestes transfers,
spouse to spouse, family, so what this is for is when there is a sale between
third parties that property will need to be dye tested by JETSA. Once we
pass this Ordinance we will be compliance with the State.

Sewers and Dye Testing Ordinance. 2nd by Woznak. 4 Ayes.
