The meeting of June 11th,
2009 was called to order by Chairperson Mary Woznak. All Stood and pledged
allegiance to the flag and observed a moment of silence for our Troops
overseas.

Drive: Requesting a signature on a grant through DCED. We were here last
year and the Township signed the grant for the problem we had down on Parkhill
Drive and we did not get the grant and the grant application only stays
on file for 1 year so we are reapplying.

Jack Foust 435 Lyman Lane:
Are you saying there is no asbestos in that gravel? Vojtowicz: We have
no proof that there is, we told you to bring us something stating that
there is. Mr. Foust: I know there is. I used to work there at Bethlehem.
I know where they dumped it. They dumped everything in the North Dump.
I went through asbestos with Goldman and Perzinsky. I got settlements on
that. I gave them all the information from working there 37 years. All
that stuff was hauled out to the North Dump. I don’t know how someone is
saying there is no asbestos in there. They dumped all those bricks
in there now you say you put ant skid on there, let me tell you that stuff
was not anti skid. Bob Ritchey: Which one is the North Dump? Mr. Foust:
Parkhill, you say you are approved to use that stuff? Peruso: I said the
State approves it for use on the roads in the winter. Mr. Foust: that wasn’t
anti-skid you put on there. Peruso: No I wasn’t over there that day. Mr.
Foust: I’m telling you it wasn’t I saw pieces of bricks in it and then
they rolled it. I t was the stuff from the North Dump. Peruso: I’m sure
it was that is where we get it. Mr.Foust: no one is telling me that there
is no asbestos in that dump; they used to bring in their garbage and burn
it in the North Dump. I know what I am talking about. If I have to get
Goldberg and Perzinsky to go over my case I will even if costs me my house
I will. My wife is dying right now. She is dying a little bit everyday
and she has to breathe this stuff from the road and you have my neighbor
who is such a good neighbor, he takes his mower and rides with the blades
on and stirs up the dust and I can’t even open my windows. He is working
up there now with stuff all over the road and you say that is not a Township
road? Well let me tell you I was there when Mr.Bittner signed over the
right of way for there. Grove was a Supervisor and he asked me to go get
Mr. Bittner to see if he would sign over the 13 feet, there was a 21 foot
right of way, Mr. Bittner said he would sign it over and he would give
us as much as he needed to get a road through there. Then you tell me that
the papers must have got lost in the shuffle. Peruso: No that is not what
I said. We get a list from the State and that road is not one of them.
I never remember us taking over that road. Mr. Foust: Your dad, Al Coleman,
they tarred and chipped it two times since they took it over. Two times
in 4 years. Your dad said that it wouldn’t take us long we will keep you
out of the dust. This is what I am going on about. I am 80 years old and
this has been going on for I don’t know how long and I am up to here with
it. I have to take care of my wife. You can’t breathe, she can’t breathe.
Let me tell you I have had it, something is going to happen either I am
going to blow my stack but before I blow my stack I think there is going
to be a hell of a lot of stuff on. I am telling you what is going on. I
have had it. I don’t care what you people do. If you don’t get it straightened
out I am going to get it straightened out. Peruso: did you bring that paperwork
up about the asbestos being in there? Mr. Foust: I don’t have proof. I
know it. I am going to go to Goldman and Perzinsky and I am going to show
them. Why should I have to do it when you know it and I know it that I
am telling the truth. Someone said you have papers saying there is no asbestos
in there? Vojtowicz: No you said you could bring proof because we don’t
know of any asbestos down there. Mr. Foust: Why should I have to get it
when you can get it? Bob Ritchey: The Dirt and Gravel Road Program did
a chemical test on it for the Dirt and Gravel Roads. Vojtowicz: did it
have asbestos in it? Bob Ritchey: I didn’t read it. Call Bobbi and tell
her you need the chemical test they did and she will get it for you. Vojtowicz:
Ok Jack we are going to see what we can do for you and get the results
of this test and see what it says. Mr. Foust: This doesn’t help me at all.
If you could see my wife. I had a boy die this August with all that dust
and that didn’t do him any good. And someone is burning and you can smell
chemicals and I can’t even open my windows.
Vikki Svencer: Thank you
for cutting the weeds on East Jackson but guess what it is raining and
Mr. Foust: Are you saying
that is not a Township Road? Peruso: All I said that it is not recognized
by the State for Funds. Mr. Foust: No what is the Township saying? No to
the best of my knowledge. I go by the papers from the State. Mr. Foust:
What about the papers from Grove and Bittner and they tarred and chipped
it twice. Woznak: If something was signed it would be recorded right? So
we need to go to the courthouse and find out. Peruso: They would adopt
roads and then a year later abandon them. Bob Ritchey: You will have to
find the Ordinance. It is over there. They would take care of a road for
a few years and then abandon it. They did that quite often. Mr. Foust:
how can they do that? Bob Ritchey: A Township can establish and abandon
a road with a vote of the Board. Mr. Foust: Another thing, my mind doesn’t
work right, thing come to me as I am talking, Am I in A residential zone?
Woznak: Yes you are. Mr. Foust: I went to pay my sewage for the tap in
fee and they told me they are not putting sewage in back there. Vojtowicz:
The Sewage Authority is their own entity; we have no control over what
they do. They are having a meeting right now, you can go up there and they
will answer your questions. Mr. Foust: Who put me in A zone? Vojtowicz:
Zoning has been around for years. Mr. Foust: I know I fought against it.
I wanted in B Zone and they said no you are in A Zone. Grove Kranowsky
and Coleman said A Zone. Vojtowicz: Everyone you are talking about is dead.
Mr. Foust: I can’t help that. I am not dead yet but I will be soon. Vojtowicz:
We can’t dispute anything that happened if we don’t have any records and
these people aren’t even here to defend themselves. Mr. Foust: But you
say I can’t do this and that then why can Mr. Kmett run a garage? Bob Ritchey:
Certain businesses are permitted in A and B. Mr. Foust: You allow a paint
shop you don’t need a permit for that? Vojtowicz: You need a permit from
the State. MR. Foust: So I can put in a junkyard? Vojtowicz: No because
we have to issue a junkyard permit from the Township. Mr. Foust: But he
can get a permit for a garage? Vojtowicz: you are comparing apples to oranges.
He is only working on 1 or 2 cars at a time. A junkyard you have thousands
of cars. You can’t compare one guy trying to make a living and a junkyard.
Mr. Foust: What’s the difference? Vojtowicz: There is a difference and
anyway your 5 minutes are up, you are holding up the meeting, if you have
a complaint about the sewage there is a meeting going on now. Mr. Foust:
I was just asking why no sewage? Vojtowicz: I have no idea go have to go
talk to them. Mr. Foust: I am asking how someone can paint cars and let
the paint come down to my place. Vojtowicz: That has no bearing on the
Township. You need to contact the State on that. Call the DEP. Shannan
will get you the number.
Audrey Vojtowicz: Why are
the State Police doing traffic control here? Thomson: I believe that we
didn’t have any officers on. Vikki Svencer: I though you raised taxes to
have 24 hour coverage? Thomson: When you have 9 officers and only
3 of them work 4 days a week you can’t cover all the shifts. Vikki: So
what is the solution? Audrey: I have a solution, buy service, we will save
a $100,000 a year and get 24 hour coverage plus a dog. I hate to see the
State Police in here. And another thing these trucks. They fly up and down
the road. They need to be stopped.

REPORT OF THE CHAIRPERSON-Mary
Woznak
We are under $40,000 owed
to us in Refuse payments. WE have $39,823.06 still not paid. We have collected
$3,328.43 from March through May 31st. Sent out 82 letters and about 20%
of those either paid in full or made payment arrangements. The Board needs
to decide on a minimum payment that we will accept from people who want
to make payments. The Board decided that you must make a 10% payment
on the amount you owe.
Bob Ritchey: these people
that owe, is their garbage still getting picked up? Woznak-yes because
Pro handles the billing now. These are past due garbage bills from when
the Township handled the billing. Kester: Pro told me that if they had
gotten a list of delinquents they wouldn’t have picked up the garbage until
it was paid. Vojtowicz: Will they do that for us now? Woznak: I will call
Pro and talk to them
I have an article here from
the Johnstown Magazine and they have a write up in here about a Jessica
Wagner from Conemaugh Valley Scholl District and she lives in Echo. She
is founder of Soup Warms the Heart. She collects soup and gives it food
banks. She really puts a lot of effort into this and this is great. I think
that we should do something to recognize the effort.

citizenship award plaque and a $50.00 donation for the Soup Warms the Heart

We got the Summer Youth
kids so we have some free help this year.
What do we have to do to
reduce a speed limit on a Township Road? Heiple It is done by Ordinance,
I would suggest doing a few at a time instead of just one. Peruso: I will
get a list together of some roads we want to change.

I would like to resign as
Police Commissioner and turn the position over to the Board as a whole.
Board accepted Art Thomson’s
resignation with a unanimous vote. Peruso-Aye, Thomson-Aye, Vojtowicz-

Vojtowicz stated that scheduling
will be turned over to the Police Chief and that we will be following the
contract and we will never deviate from the contract. Police Officers will
report to Chief Price. The chain of command for the Police Department will
be as follows: Chief, Chairperson, Vice Chairperson and then the Other
Board members. If the complaint is about the Chief then the complaints
goes to the Chairman, Vice Chairman and then the other Board members.

4. Thomson: What about the
old police car? Do we want to sell it or are we going to keep it for a
second vehicle? Peruso: Meanwhile the new one down there, I don’t care
what you do with the old one, but the new one is in the way of where I
weld. It needs to be moved. I have welding that needs done and it is way
to close. And I guess you have the key? Thomson-The Chief has the key.
Vojtowicz: Don’t we have room in the other building. Just put the new one
over there and leave the old one in the garage. Peruso: I would rather
have the old one over there. Vojtowicz: The old one is still in service
with all the equipment. Woznak: What do we want to do with the old one?
Vojtowicz: We can’t do anything with it yet, because it is still in service
so we can wait until next month before we do anything. I was under the
impression that was a brand new vehicle. We bought that new cruiser and
when we got it, it had 25,000 miles on it. I was under the impression it
was new, a leftover 2008 model and had some miles in it but not 25,000.
We bought a used Police Car. Woznak: Shame on us for not asking.
It should have been disclosed to us. I am not happy about this at all.
Thomson: They never disclosed the mileage. Shannan: No I don’t think they
did. It was a demo model, we knew that but I don’t think in any of the
paperwork they sent to Art that the mileage was disclosed. Vojtowicz: is
there something we can do about it? Heiple: I would think there is, I will
look into it.
5. Heiple: There is a lady
down in WestPoint who would like to raise alpacas and we also have another
resident raising animals down there but that area is residential and all
the area around it is farm land so we might want to consider changing that
area and blending it all in together to agricultural. And we also need
work on getting the others areas we discussed changed. Vojtowicz: We need
to get the input from the residents down there first.
6. Motion to hold an informational
meeting on zoning and advertise for July 8th, 2009at 10 A.M. and also send
letters to everyone on WestPoint Road made by Woznak. 2nd by Vojtowicz.
